Last updated: 6 August 2026

These Terms and Conditions apply to your use of https://capetownbakery.co.za and to orders placed through the website.

By accessing the website, creating an account or placing an order, you agree to these Terms and Conditions.

1. Business Information

This website is operated by:

Trading name: Cape Town Bakery
Legal entity or proprietor: Minipoli Pty LTD
Registration number, if applicable: Available on request
Business address: Available on request
Email: info@capetownbakery.co.za
Telephone: 0822532830

2. Age Restriction

This website and all cannabis or THC-containing products displayed on it are intended only for adults aged 18 or older.

By using the website or placing an order, you confirm that:

  • You are at least 18 years old.
  • The information you provide is accurate.
  • You are legally permitted to possess and use the products concerned.
  • Any cannabis product will be received, stored and used only in a lawful private setting.
  • You will not supply any cannabis product to a child.

We may request proof of age and may refuse access, cancel an account or decline an order if age verification cannot be completed.

3. South African Cannabis Law

South African law permits certain adult possession, cultivation and use of cannabis in private, but it continues to restrict and prohibit dealing in cannabis outside a legally authorised framework.

Nothing on this website should be interpreted as stating that every cannabis transaction is lawful in every circumstance.

The availability, acceptance and fulfilment of any order are conditional on Cape Town Bakery being legally entitled to supply the product and the customer being legally entitled to receive it.

We may refuse or cancel an order where fulfilment could contravene applicable law, regulatory requirements, service-provider rules or a lawful direction from an authority.

You are responsible for obtaining independent legal advice if you are uncertain about your legal position.

4. Private Adult Use

Cannabis products are intended only for responsible adult use in private.

You agree not to:

  • Supply cannabis to anyone under 18.
  • Use cannabis in public where prohibited.
  • Drive, operate machinery or perform hazardous work while impaired.
  • Carry products across an international border.
  • Resell or commercially distribute products.
  • Use the products in connection with unlawful activity.
  • Misrepresent your identity, age or intended use.

5. Product Information

We take reasonable care to describe products accurately. However:

  • Product appearance may vary between batches.
  • Handmade and small-batch products may differ slightly in colour, size, texture or finish.
  • Flower is a natural agricultural product and may vary between harvests.
  • Product images are illustrative and screen colours may differ from the physical product.
  • Stated cannabinoid amounts may be estimates unless a product or batch is specifically identified as independently tested.
  • Independent testing of one flower strain or batch must not be interpreted as testing of every finished product or every later batch.

Only products expressly described as independently tested should be treated as such.

6. Responsible Use and Edible Products

Cannabis affects people differently.

For edible products:

  • Read the product label and directions before use.
  • Begin with a low serving.
  • Wait at least two hours before considering an additional serving.
  • Do not consume more merely because effects are delayed.
  • Keep products securely stored away from children, pets and anyone who may mistake them for ordinary food.
  • Do not mix cannabis with alcohol, medication or other substances without appropriate professional advice.

Effects may last for several hours and may continue longer than expected.

7. Health Disclaimer

Cape Town Bakery does not provide medical advice.

Unless specifically registered and supplied as an authorised medicine, products are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Do not use cannabis without appropriate medical advice if you:

  • Are pregnant or breastfeeding.
  • Have a heart condition.
  • Have a history of psychosis or another serious mental health condition.
  • Take prescription medication.
  • Have a medical condition that may be affected by cannabis.
  • Have previously experienced an adverse reaction to cannabis.

Seek urgent medical assistance if you experience a severe or unexpected reaction.

8. Allergens and Ingredients

Product pages and labels may identify ingredients and known allergens. Our products may be made in an environment where common allergens are handled, including nuts, peanuts, dairy, eggs, gluten, wheat and soya.

If you have a serious allergy, contact us before ordering. You remain responsible for checking the ingredient and allergen information supplied with the product before consumption.

9. Orders

Placing an order is an offer to purchase and does not automatically mean the order has been accepted.

An order is accepted only once:

  • Payment has been received or approved.
  • Stock has been confirmed.
  • Any required age or identity verification has been completed.
  • We have confirmed that the order can lawfully and operationally be fulfilled.

We may decline or cancel an order because of:

  • Stock unavailability.
  • Pricing or website errors.
  • Suspected fraud.
  • Failed payment.
  • Failed age verification.
  • Delivery restrictions.
  • Legal or regulatory risk.
  • Service-provider restrictions.
  • A quantity suggesting resale or commercial distribution.

If we cancel an order after receiving payment, we will refund the amount due, subject to lawful deductions where applicable.

10. Prices and Payment

Prices are displayed in South African rand.

Cape Town Bakery is not currently registered for VAT.

Accepted payment methods will be displayed during checkout and may include Yoco and electronic funds transfer.

Orders paid by electronic funds transfer will not be processed until the funds have cleared and been matched to the order.

We may correct an obvious pricing or product-description error before accepting an order. If payment has already been made, you may choose to accept the corrected price or receive a refund.

11. Promotions and Discount Codes

Promotions and discount codes:

  • Are valid only for the stated period.
  • Cannot be exchanged for cash.
  • May be limited to one use per customer or order.
  • May exclude particular products.
  • Cannot ordinarily be combined unless stated otherwise.
  • May be withdrawn where used fraudulently or contrary to the stated conditions.

You are responsible for providing correct delivery details and ensuring that an adult aged 18 or older can receive or collect the order.

13. Cancellations, Returns and Refunds

Contact us as soon as possible if you wish to cancel an order.

An order that has already been prepared or dispatched may not be capable of cancellation.

Opened food, edible and ingestible products cannot ordinarily be returned for a change of mind because of health and hygiene considerations.

Nothing in these Terms excludes your rights under the Consumer Protection Act, including applicable rights relating to goods that are defective, unsafe, incorrectly supplied or not reasonably fit for their intended purpose.

Approved refunds will ordinarily be returned using the original payment method. Processing times may depend on the relevant bank or payment provider.

14. Website Accounts

You are responsible for:

  • Keeping your login details confidential.
  • Providing accurate account information.
  • Restricting access to your device.
  • Informing us if you suspect unauthorised use of your account.

We may suspend or close an account used fraudulently, unlawfully or in breach of these Terms.

15. Reviews and User Content

If you submit a review, photograph, comment or other content, you confirm that:

  • It is truthful and based on your genuine experience.
  • It does not infringe another person’s rights.
  • It is not unlawful, threatening, defamatory or misleading.
  • It does not contain another person’s private information.
  • It is not submitted in exchange for an undisclosed incentive.

We may moderate or remove content that breaches these requirements.

16. Intellectual Property

The Cape Town Bakery name, branding, photographs, graphics, product copy, website design and other original content belong to Cape Town Bakery or are used with permission.

You may not copy, reproduce, commercially exploit or falsely represent our content without prior written permission.

17. Acceptable Website Use

  • Use automated systems to place excessive or abusive orders.

18. Third-Party Services

Our website may use third-party services such as hosting providers, WooCommerce, Yoco, Klaviyo, Google Analytics and courier platforms.

These providers may have their own terms and privacy policies. Cape Town Bakery is not responsible for a third party’s independent services or systems, except to the extent required by law.

19. Website Availability

We try to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.

We may suspend or modify the website for maintenance, security, legal or operational reasons.

20. Limitation of Liability

To the fullest extent permitted by law, Cape Town Bakery will not be liable for indirect or consequential loss arising from:

  • Improper, excessive or unlawful use of a product.
  • Ignoring product directions or warnings.
  • Allowing access by a child or pet.

  • Website or courier interruptions beyond our reasonable control.

Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded under the Consumer Protection Act or other applicable legislation.

21. Indemnity

To the extent permitted by law, you agree to hold Cape Town Bakery harmless from claims arising directly from your unlawful use, resale, supply, storage or handling of products, or from a material breach of these Terms.

This clause does not apply where the loss was caused by Cape Town Bakery’s unlawful conduct, gross negligence or another matter for which liability cannot legally be excluded.

22. Privacy

Personal information is processed according to our Privacy Policy, which forms part of these Terms.

23. Changes to These Terms

We may update these Terms when our business, website or legal obligations change.

The version published at the time an order is accepted will ordinarily apply to that order. Continued use of the website after an update constitutes acceptance of the revised website-use terms.

24. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa.

Before beginning formal proceedings, both parties should attempt to resolve a dispute in good faith through direct communication.

Nothing in this clause prevents a consumer from approaching the National Consumer Commission, a competent consumer tribunal, the Information Regulator or a court with jurisdiction.

25. Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply.
